Who is the Importer of record under import of goods in United States US?
As you are aware, necessary import documents are to be filed at a port of importing country for import clearance procedures and formalities. In this article we are discussing about the parties authorized by US customs CBP to clear import consignment. As per 19 USC 1484 Federal Law, an Importer of record has the right to make entry under import of goods to US.
What does Importer of Record mean in US import clearance? Who is importer of record authorized by US under import of goods to US?
According to 19 usc 1484, the owner, purchaser or licensed customs broker designated by the owner, purchaser, or consignee is called Importer of record who can file necessary documents against imported goods in US. Necessary examination and release of goods imported to US are arranged by such Importer of record who is responsible to act so.
Who is the Owner or Purchaser under Importer record authorized to make necessary import entries in US?
Owner or purchaser means any party with a financial interest in a transaction, including, but not limited to, the actual owner of the goods, the actual purchaser of the goods, a buying or selling agent, a person or firm who imports on consignment, a person or firm who imports under loan or lease, a person or firm who imports for repair or alteration or further fabrication, etc. The terms 'owner' or 'purchaser" would not include a 'nominal consignee' who effectively possesses no other right, title or interest in the goods except as he possessed under a bill of lading, air waybill, or other shipping document. " (Customs Directive 3530-00A, dated June 27, 2001, superseding Directive 3530-002 dated November 6, 1984.)
Can carrier of goods authorize Importer of Record to complete necessary import clearance procedures in US? Yes, A Carrier can appoint an importer of record by issuing a Certificate in the specified format which is called Carrier’s Certificate to file entry of documents with US customs under Import goods for clearance.
