Some of the traders need to know whether they can obtain bill of lading before loading cargo in to container. I will say ‘yes’, an exporter can obtain bill of lading before loading container. However, before obtaining bill of lading, the legal export customs clearance procedures and formalities must be completed.
Bill of lading is issued by carrier on receipt of goods from ship
per. So, the earliest date of issue of bill of lading is the date of receipt of goods from shipper by shipping carrier. Let the shipping carrier be a freight forwarder, consolidator, or main shipping companies, the carrier can issue bill of lading once after receipt of goods. Now, we need to know the actual meaning of ‘receipt of goods from shipper’. Any goods can be moved out of country only after completion of export customs formalities of the respective country. Here, the carrier of goods ‘receives’ goods with a proof of completion of export customs formalities.
So it is clear that, carrier can release bill of lading only once after completion of export customs clearance procedures and formalities under the said shipment.
To issue a bill of lading, the cargo need not be loaded in to container, if customs clearance formalities have been completed. For example, in a container freight station where in the exportable goods are available, the exporter or his customs house agent can complete necessary export customs procedures at the said Customs warehouse. Let the cargo be an LCL or FCL shipment, the physical examination of cargo by customs officials if required can be undertaken either inside CFS or on the customs bonded yard. Once after completion of export customs clearance procedures, exporter is eligible to obtain bill of lading from shipping carrier of goods. In short the shipper is eligible to release bill of lading from shipping carrier,once after completion of export customs formalities.
