PRAVEEN RANA: DEFINE RE-IMPORTS WITH REAL EXAMPLE

mei ling: I hope you can enlighten me in the following matter. We have exported 4200pcs LCD parts to customer in India. Unfortunately 600pcs of wrong parts were shipped. We are required to ship the 600pcs correct items and to obtain a return of the 600pcs wrong items. Since the customer would have already declared and paid the IGST for the total 4200pcs , the 600pcs correct parts which we intended to ship does it attract another 18% IGST? If so can the re-exported 600pcs obtained a refund? Also we will prepare a proforma invoice for the re-ship of the 600pcs correct items. We have stated as no commercial value since it is a exchange of parts . Our customer is not expected to Pay under this proforma invoice . Will the commercial invoice still attract IGST? Can we declare a lower value for in the proforma invoice (see attachment) as it is only intended to facility shipment only. I shall look forward to a reply from you

Inocencio: Good day, In the case presented, you will not have to pay Duties to the replacement of the goods wrongly delivered. Your client has to inform the Customs Authorities in India through his Agent of the return of the goods. Generally, before the Authorization is granted, Customs has to do physical examination and approve the request to RETURN the goods. Therefore, you wont be Importing neither to your Country no to your Customer.
