DAP terms, whose responsibility for import customs clearance?

 

DAP means Delivered At Place. Under DAP, It is the Seller’s responsibility to deliver goods at a named place mentioned in the contract of carriage mutually agreed by buyer and seller.  

Here the question is whether the buyer or the seller has to undertake import customs clearance at destination port in buyer’s country?

The Exporter meets the risks and costs of pre carriage, export customs clearance , export customs process, main carriage and on carriage from  destination port to buyer’s  named location at buyer’s country. 

Although the goods  are delivered at named place or buyer’s premises at his country,  Under DAP terms, the buyer is responsible for import customs clearance and taxes if any at importing country.

Under DAP terms, the unloading of goods is at buyer’s risk and cost.

Ramakrishnan: under the incoterms of DAP with named place, which is outside the port, who should take care of customs clearance, as per INCO terms explained under DAP the customs clearance will be handled by the buyer, but if the named place is other than port or buyer's premises and seller's responsibility is to deliver the goods at buyer's premises, how buyer will handle the customs clearance, please clarify.
