FAS - Free Along Side (named place) INCO TERMS 2020
FAS Terms of Deliver is one of the marine restricted Inco Terms 2020, thereby preferably used under Sea and Inland water mode of transport.
Under FAS terms, the responsibility of seller transfers to buyer immediately up on placing the goods next to vessel planned by the buyer. So the seller packs the goods and undertakes pre carriage at his on cost and risk and arranges to reach the goods at port of shipment which buyer nominated. Once the goods are placed at the location nominated by the buyer where the ship is planned to berth, the obligation of seller ends under FAS terms of delivery of goods.
At load port, if any delay in berthing the Vessel, Cancellation of Vessel or Port congestion delay, the seller is not liable for any detention charges, damage of goods or any other loss. So the FAS terms of delivery is not suggestible for importers.
Usually, FAS is not used under Air shipment, as the goods are not allowed to place near an Aircraft due to security reasons, thereby ICC defines this term as marine restricted incoterms.
Who arranges insurance under FAS Inco Terms?
As described earlier, if the three letter words do not contain ‘I’, Inco terms rules are silent about the parties who is responsible to undertake the risks and cost of Insurance. Since the Incoterms 2020 does not state anything about the rules of Insurance under FAS terms, neither the buyer nor the seller is responsible for arranging insurance for movement of goods. However, the buyer or seller may arrange insurance as per the agreed terms and conditions of their Sale Contract.
