OBL NOT RELEASED / NO TELEX RELEASE / OBL NOT SURRENDERED
Have you heard of these terms OBL NOT RELEASED, NO TELEX RELEASE or OBL NOT SURRENDERED? If you are in an import department who has regular imports, I believe, some of you know these terms OBL not released, OBL not surrendered or No Telex Release.
Let us discuss about these terms you receive from a carrier or his agent at destination port. In this article, I would like to explain about release of imported goods at destination port, consequences of non release of Bill of Lading at load port even after arrival of goods at destination port and the reasons for non release of OBL at load port by shipper.
Once after completion of import customs formalities, importer or his customs broker approaches carrier to obtain Delivery Order against imported shipment to take delivery of his goods. Original bill of lading issued by carrier at load port has to be surrendered with carrier at destination port to obtain delivery order, unless otherwise Sea Way Bill or surrender of OBL arranged. While checking with bank, importer may realize that Original Bill of Lading is not available with the pouch. He immediately calls supplier and enquires for OBL. Or the carrier at destination port sends message to his counterpart at load port seeking the status of original bill of lading. Then he comes to know the fact – ORIGINAL BILL OF LADING NOT RELEASED.
OBL Not Released? Original Bill of Lading not released even after arrival of goods at import location?
This is common phenomena facing by some of the traders in the field of import and export - OBL NOT RECEIVED, NO TELEX RELEASE or OBL NOT SURRENDERED AT LOAD PORT. What would be the reason behind ‘No telex release , No Release Message or No Surrender message on OBL?
Why delay in releasing Bill of Lading?
The delay in releasing OBL happens mostly because of nonpayment of ocean freight by exporter, as he ‘enjoys’ maximum credit period extended by either shipping line or his freight forwarder. Usually, exporter delays release of OBL under a shipment moved by a Freight Forwarder. However, the shipping carriers who own Vessels impose penal charges against non release of Original Bill of Lading.
What are the consequences on non release of bill of lading even after arrival of goods at destination port?
If buyer is unable to take delivery of imported goods, there could be a huge loss against non receipt of goods in time other than the inconvenience. The importer may have to pay demurrage/detention on goods imported, as Carrier of goods cannot release goods unless he receives OBL or release message on surrender of OBL at load port. Ultimately, all expenses and losses returns back to Exporter who is responsible for such losses.
Without releasing OBL and surrendering, carrier at load port do not send OBL surrender message or telex release to destination port, as the carrier at load port needs to receive ocean freight and other charges against shipment.
