Chintan Vora : I am working with one shipping company in Mumbai as an sales executive. I am dealing with one shipper presently I did one his shipment to be Frank with you he is doing issue in payment terms he takes credit and latter on he does bt make the payment to forwarding company. As I had deal with him for 2 shipments. My earlier shipments payment is also still outstanding. As of this shipment our company had hold his all the documents I.e. (OB/L , shipping bills, ep copy, & all others) We had Nw asked him to make the all payment NEFT and said then only will release the B/L. Nw in this stage for my safe side I just want to clear if his consignee approch to shipping line at destination (Africa) for Duplicate bill of lading can he get the same and release the container ?? Else plss request you give me some safe options so that I recover my payment in my company's interests.

Admin: Chintan Vora, Your experience is common to some of the freight forwarders, as they have no option to get their payment, but hold shipment without releasing BL or holding ORIGINAL BILL OF LAIDNG without sending to destination after releasing from main shipping carrier.

Naveen: I have a doubt regarding a Seaway Bill Release of the shipment by a shipping line to the consignee. The Seaway BL of the shipping line has a clause under it saying ** Proof Reading Copy – Not useable for Cargo Delivery ** Consignee has destination chopped on this copy & submitted to the shipping line & delivered the container to the consignee. Please confirm is shipping line right on its part to release the cargo to the consignee.

Admin: Hi Naveen, As per my knowledge, the cargo can be delivered to consignee/importer only after obtaining ORIGINAL BILL OF LADING OBL SURRENDER MESSAGE FROM LOAD PORT OF CARRIER unless EXPRESS RELEASE / SEA WAY BILL is released at loading port.

FRANK OTENDA: Explain the purpose of IMO (international maritime dangerous code) and the details found within the dangerous goods shipping note also clearly identfy the different clauses

Kumaran : Gas Turbine (GT) Make – Siemens, Model - Allison 501 KB5 is used as prime mover for power generation at Captive Power Plant of ONGC Ltd., Sivasagar, Assam, India. We have 3 nos of GT Allison 501 KB5, which needs to be sent for overhaul to OEM works at Houston, USA. The GTs were earlier overhauled in India only by authorized service center. However due to expiry of licence, service center is no more authorized to carry out these overhauls These GTs were initially imported in Year 1989 from USA. We have copies of Bills of entry of same. While inquiring about the export procedures, we came to know that copy of 1. Bill of Entry 2. Bill of Lading 3. Invoice for initial / original import (year 1989) is required for customs clearance for export and re-import. Since GTs are more than 25 years old, records from the same time is not available. As of now we dont have any other document except Bills of Entry.

Many exporter do not mention actual buyer name in shipping bill and mention as dummy/ agent name being they do not want to disclose the buyer name to custom department or in many cases this is due to third party involvement ...

Jacob Ebanezer : We are into export business of engineering parts. We manufacture the parts in-house and in some cases buy from suppliers. But with the current exposure of exports data available in the market, many intruders like traders/competitors end up taking away our hard earned business. In the last 13 year of business, I have never been involved in such practises, nor I have exported to any customers outside India who are already buying from INDIA. I have always brought new users to India and thereby contributed my portion to bring more customers / foreign currency to India.I would like to receive some advice with your expertise to safeguard our business. Particularly in hiding the name of customer in shipping bills, bill of lading, etc. I heard that invoicing to the customer's bank and delivering the shipment to customer's premise is the safest way

Kiran Ajmera : Saw one of your inputs on the net regarding switch bill of lading. Whilst it is clear that you can switch bill of lading if you are in a 3rd country (not origin nor destination), I would like to know if it is possible to switch bill of lading within the same country. For example, shipment from China ABC to India ABC as original bill of lading. Now, can India ABC switch bill of lading to India XYZ as new consignee? Second, it is possible then for India ABC to raise USD invoice rather that in INR? Presume the second one is more difficult.
