(i) “Construction of Complex” means —

(a) construction of a new residential complex or a part thereof; or

(b) completion and finishing services in relation to residential complex such as glazing,

plastering, painting, floor and wall tiling, wall covering and wall papering, wood and

metal joinery and carpentry, fencing and railing, construction of swimming pools,

acoustic applications or fittings and other similar services; or

(c) repair, alteration, renovation or restoration of, or similar services in relation to,

residential complex;

(ii)“Residential Complex” means any complex comprising of—

(i) a building or buildings, having more than twelve residential units;

(ii) a common area; and

(iii) any one or more of facilities or services such as park, lift, parking space, community

hall, common water supply or effluent treatment system, located within a premises and the

layout of such premises is approved by an authority under any law for the time being in

force, but does not include a complex which is constructed by a person directly engaging

any other person for designing or planning of the layout, and the construction of such

complex is intended for personal use as residence by such person.

Explanation. — For the removal of doubts, it is hereby declared that for the purposes of

this clause, —

(a) ?personal use? includes permitting the complex for use as residence by another person

on rent or without consideration;

(b) ?residential unit? means a single house or a single apartment intended for use as a

place of residence;

Goods and Service Tax (GST) rate tariff in India is designed in 6 categories of goods and services.  Four main GST rate slabs framed with Essential goods and services, Standard goods and services and luxury goods and services with 5%, 12%, 18% and 28% respectively.  Commonly used Goods and Services at 5%, Standard Goods and Services fall under 1st slab at 12%, Standard Goods and Services fall under 2nd Slab at 18% and Special category of Goods and Services including luxury - 28%.   The most essential goods and services attract nil rate of GST under Exempted Categories.     Luxury goods and services and certain specific goods and services   attract additional cess than 28% GST.

 

The GST for construction of residential complex service is expected to be 12% or 18%.  If there is proper application of the credit utilization mechanism, then the developers should be able to obtain credit for number of taxes paid on inputs, which will eventually help reducing the overall cost.

Some of the categories under completion and finishing services like construction of swimming pools in relation to residential complex are exempted from paying GST.  The list of exempted business category of services under repair services may be read in GST exemption category list issued by GST authorities.

PARTHA SENGUPTA: I purchased a flat of Rs. 20,00,000.00 and paid of Rs. 14,00,000.00 plus service tax. The flat handed over to me on Aug 2019. Should I pay the GST on Balance amount or GST will be calculated on total value of Flat and the previous service tax which i had paid earlier, will be adjusted with the GST amount. Pl. clarify me

Ashok Kumar Birmecha: Goods and Service Tax rate on park facilities provided in residential complex related services--- I have asked to pay Rs.170000 for parking in booking a flat in an appartment with G S T charges. GST on flat in full amount or a part of it ? GST on parking space may not be applicable as it is not a service-?

Tamal Mohanta: Please explain whether gst is applicable for under construction building having less than 12 flats in it.according to circular no- 108/02/2009 dated 29-01-2009 service tax is applicable for under construction building having more than 12 flats in it.GST replaced service tax in real estate. So whether this circular will be applicable for gst or not.
