Is IEC compulsory for Exports and Imports in India

This post explains about the details of exempted categories to obtain Import Export Code number to act as importer or exporter in India.

According to Foreign Trade Policy of India, IEC is compulsory for import and /or exports. However, the following categories of importers or exporters are exempted from obtaining IEC.

(i) Importers covered by clause 3(1) [except sub- clauses (e) and (l)] and exporters covered by clause 3(2) [except sub-clauses (i) and (k)] of Foreign Trade (Exemption from application of Rules in certain cases) Order, 1993.

(ii) Ministries /Departments of Central or State Government

(iii) Persons importing or exporting goods for personal use not connected with trade or manufacture or agriculture.

(iv) Persons importing/exporting goods from/to Nepal, Myanmar through Indo-Myanmar border areas and China (through Gunji, NamgayaShipkila and Nathula ports), provided CIF value of a single consignment does not exceed Indian Rs.25,000. In case of Nathula port, the applicable value ceiling will be Rs. 1,00,000/-

Further, exemption from obtaining IEC shall not be applicable for export of Special Chemicals, Organisms, Materials, Equipments and Technologies (SCOMET) as listed in Appendix - 3, Schedule 2 of ITC (HS) except in case of exports by category (ii) above.

(b) Following permanent IEC numbers shall be used by non – commercial PSUs and categories or importers / exporters mentioned against them for import / export purposes:

1 0100000011 - All Ministries / Departments of Central Government and agencies wholly or partially owned by them.

2 0100000029 - All Ministries / Departments of any State

Government and agencies wholly or partially owned by them.

3 0100000037 - Diplomatic personnel, Counsellorofficers in India and officials of UNO and its specialised agencies.

4 0100000045 - Indians returning from / going abroad and claiming benefit under Baggage Rules.

5 0100000053 - Persons /Institutions /Hospitals importing or exporting goods for personal use, not connected with trade or manufacture or agriculture.

6 0100000061 - Persons importing/exporting goods from /to Nepal

7 0100000070 - Persons importing / exporting goods from / to Myanmar through Indo-Myanmar border areas

8 0100000088 - Ford Foundation.

9 0100000096 - Importers importing goods for display or use in fairs/ exhibitions or similar events under provisions of ATA carnet. This IEC number can also be used by importers importing for exhibitions/fairs as per Paragraph 2.63 of Handbook of Procedures

10 0100000100 - Director, National Blood Group

11 0100000126 - Individuals /Charitable Institution /Registered NGOs importing goods, which have been exempted from Customs duty under Notification issued by Ministry of Finance for bonafide use by victims affected by natural calamity.

12 0100000134 - Persons importing/exporting permissible goods as notified from time to time, from /to China through Gunji, NamgayaShipkila and Nathula ports, subject to value ceilings of single consignment as given in Paragraph 2.07 (iv) above.

13 0100000169 - Non-commercial imports and exports by entities who have been authorised by Reserve Bank of India.

Prasanna: Dear sirs, Can a limited company apply for Dummy IEC (0100000053) permission from different ports and get the shipment cleared. As i understand Dummy IEC is an exceptional case and the importing company need to apply for their own IEC before importing next shipment.

bhavnesh pandya : File has been returned from custom. As per CE report, goods are found to be old and used parts of Wood WORKING Machinery which are restricted to import as per Indian Customs hence case will be adjudicated i.e. will levy fine and penalty for violation of FTP rules and regulations. Also, please note there is requirement of NOC from MOEF-Ministry of Environment & Forest, without the same shipment will not be clear from custom. Please provide below mentioned documents to arrange cleareance. 1)Fine and penalty acceptance letter. 2)First Offence Declaration. 3)IEC- Import Export Code. 4)NOC from MOEF.

At this moment, I am still stuck at some critical questions about exporting tea and would appreciate any help that I can get from you. So I have set up a prop firm, applied for IEC, next step is to go for tea board certification. While reviewing the requirement for that, I saw that they give an 'export license' and a distributor license' and I am not sure which one to apply for. I will be generally, purchasing tea from a manufacturer here in Delhi, and exporting it to Chile, where couple of supermarkets will be purchasing it, and I will also be selling it independently. I liket to know that for Importing Almonds and pisthachio is that IEC code is enough or required some other licenses or seperate import export license required. Please clarify my doubt.

vibin: I am an ayurvedic practitioner working in Bahrain now .I have a doubt regarding the shipment for my personal purpose .Before , while i was working in kerala used to import some herbal products naming labaik , montalin ( indonesian products ) from indonesia to cochin in the EMS air shipping service .Normally there was no problems regarding that and the customs not asked me to submit or showing documents for that .But it was about 20 - 25 kg shipment .In future i would like to ship more quantity about 125 to 150 kg .Please tell me the chances for any blockage for my shipping , if it happens how i can solve the issues .What are the documents needed for that ?

hiimaans: We r a start up company. We formed a registered with get n have IE code. Now from some of our exporters asking us to get central excise certificate. Our auditor updated in central excise with gst. Now how can we get the above said certificate.
