Import Customs duty changes as per budget 2015-16 under HS code Chapter 90 OPTICAL, PHOTOGRAPHIC, CINEMATOGRAPHIC, MEASURING, CHECKING, PRECISION, MEDICAL OR SURGICAL INSTRUMENTS & ACCESSORIES

 

budget6 copyAs per Indian Budget 2015-16, the following customs import duty changes have been declared under import of  OPTICAL, PHOTOGRAPHIC, CINEMATOGRAPHIC, MEASURING, CHECKING, PRECISION, MEDICAL OR SURGICAL INSTRUMENTS & ACCESSORIES.


Please find below the extract of government notification:

“1) CVD is being exempted on specified raw materials for use in the manufacture of pacemakers, subject to actual user condition. Notification No. 12/2012-Customs, dated 17th March, 2012 as amended vide notification No.10/2015- Customs, dated 1st March, 2015 [new S. No. 488A] refers. Further, these good are also being exempted from SAD subject to actual user condition. Notification No. 21/2012-Customs, dated 17th March, 2012 as amended vide notification No.11/2015- Customs, dated 1st March, 2015 [new S. No. 14E] refers.

2) Basic Customs Duty on specified inputs for use in the manufacture of flexible medical video endoscope is being reduced from 5% to 2.5%. Notification No. 12/2012-Customs, dated 17th March, 2012 as amended vide notification No.10/2015- Customs, dated 1st March, 2015 [new S. No. 474A] refers.

3) Basic Customs Duty and CVD is being fully exempted on artificial hearts (left ventricular assist device). Karthikeyan Mallika : I have a plan to import 7800 Rims (one 20 feet container) copier paper (A4 - 80 GSM) - HS Code - 4802.69.90 from Indonesia. I am an independent and don't have any registered company in India. After this import I am planning to open a stationary shop as a distribution center for this product in Chennai. I would like to get your advise for the following points. 1. Can I do this import as an individual using import agent? 2. Do I need any registered company? 3. If I must need registered company, What are the minimum formalities & cost for the registrations? Can I register the stationary shop as an import company? 4. I have a friend who got a engineering solution company, Can I use that company for this import & Release the order to supplier? If Can, Later Can I open the LC in my name? 5. Can I open LC in ICICI bank as an Individual? 6. What are the important points I need to include in the contract with the supplier? 7. What would be the best payment & Delivery term for this kind of business? 8. What would be the customs duty for this import? (Indonesia coming under ASEAN free trade) 9. What are the major risk factors in this import? 10. If my product value is around 5000 USD, then how much budget I need to plan? (Until the product get cleared from the Chennai port)

Shyam Mani: I would like to know if medical devices bought for personal use to treat a chronic condition in a patient, are exempt from any customs duty and charges. This is not for sale but specifically for a personal use. The machine is oxygen concentrator which does not come with any oxygen cylinders. Its a small machine that absorbs atmoshpheric air and concentrates the oxygen and supply to the patient. It is small and portable and hence improve the quality of life for patient. Please clarify.

Robin Das Gupta : My company is a small exporter of leather products from Kolkata. Last month we exported 180 pieces of a portfolio. On account of a problem of distortion of the product, I need to bring back the 180 pieces for rectification and then send it back to them. Our forwarder tells us that we would have to pay an import duty of 26% or so and that cannot be claimed back even if after we re-export the products. Is that the case? The drawback for the 180 pieces has not been credited to our account till now. How can I go about with this?
