Reduction of Import Excise duty as per budget 2015-16 under HS code Chapter (ITC) 81 NUCLEAR REACTORS, BOILERS, MACHINERY & MECHANICAL APPLIANCES, COMPUTERS

budget18 copyAs per Indian Budget 2015-16, the following excise import duty changes have been reduced  under import of Nuclear reactors, boilers, machinery and mechanical appliance, parts.

Please find below the extract of government notification:

“1) Excise duty exemption is being withdrawn on solar water heater and system. Item-5 of List-8 of notification No.12/2012-Central Excise, dated 17th March, 2012 as omitted vide notification No.12/2015-Central Excise dated 1st March, 2015. Further, optional excise duty of Nil without CENVAT credit / 12.5% with CENVAT credit is being extended to solar water heater and system. Notification No.12/2012-Central Excise, dated 17th March, 2012  Notification No.12 of 2012-Central Excise, dated 17th March, 2012.pdf as amended by notification No.12/2015-Central Excise dated 1st March, 2015 Central excise Notification No. 12 of 2015-CE, dt. 01-03-2015.pdf [new S. No. 238A] and Clause 104 of the Finance Bill, 2015 refer.

2) Excise duty exemption on parts for use in manufacture of solar water heater and system is being continued, subject to actual user condition. Notification No.12/2012-Central Excise, dated 17th March, 2012 Notification No.12 of 2012-Central Excise, dated 17th March, 2012.pdf as amended vide notification No.12/2015-Central Excise dated 1st March, 2015 Central excise Notification No. 12 of 2015-CE, dt. 01-03-2015.pdf  [new S. No. 238B] refers.

3) Excise duty of 2% without CENVAT credit / 12.5% with CENVAT credit is being provided to tablet computer. Notification No.12/2012-Central Excise, dated 17th March, 2012 as amended by notification No.12/2015-Central Excise dated 1st March, 2015 [new S.No.254A] and relevant entry in Clause 104 of the Finance Bill, 2015 refer.

4) Further, excise duty is being exempted on parts, components and accessories for use in manufacture of tablet computer. Excise duty is also being exempted on sub-parts for use in manufacture of parts, components and accessories of tablet computers. These exemptions are subject to actual user condition. K Ravi Sundar: what is the rate of excise duty on special purpose machines, computerised numerical control machines and machinery parts from 01-03-2015

Shadab Khan : I want to purchase a tablet PC (Microsoft surface 3 worth US $499) and a digital pen (surface pen worth US $50) from USA for teaching purpose. I know that if I import these items via normal post or EMS I will be charged 41.2% duty on CIF + penalty+ fine (because I faced it last time when I imported a mini projector from China). I want to know the rate of custom duties if I import these items by DHL. Will the penalty and fine still be applicable on these items? I also heard that finance ministry has increased import duties on tablet PC, is it so? If yes, what is the current duty rates for tablet PC imports.

PRIYANKA: what is the rate of excise duty on manufacturing of machinery parts from 01-03-2016>???

Pankaj: We have fulfilled our Export obligation but do not have proper documentation of Machinery Purchased on which Excise Duty is paid by us. So till date our case is pending and refund is not received by us. Please let me know that excise duty refund will be available to us after completion of export obligation or installation of machinery.
